1. PURPOSE AND SCOPE
1.1 Purpose. This Acceptable Use Policy ("AUP") defines the rules that govern permissible use of the TrendArcher platform ("Platform") and all associated services. The AUP protects the integrity of the Platform, the security of all users, the rights of third-party data providers, and the Company's ability to operate a lawful and sustainable service. 1.2 Incorporation. This AUP forms part of our Terms of Service and is legally binding on all users. Capitalised terms used but not defined in this AUP have the meanings given to them in the Terms of Service. By accessing or using the Platform, you agree to this AUP in full. If you do not agree, you must immediately stop using the Platform. 1.3 Scope of Application. This AUP applies to: All registered account holders and subscribers Any person or entity accessing the Platform on behalf of a registered account holder Any automated process, script, or application accessing the Platform using credentials belonging to a registered account Any use of Simulation results, data exports, or any other output derived from the Platform 1.4 Updates. We may update this AUP at any time. Material changes will be communicated in accordance with Section 17 of the Terms of Service. Continued use of the Platform after an updated AUP takes effect constitutes acceptance of the revised terms.
2. PERMITTED USE
You are authorised to use the Platform solely for the following purposes: Running Simulations to model the hypothetical historical performance of technical indicator strategies on cryptocurrency pairs Analysing, reviewing, and exporting your own Simulation results for personal or internal business research purposes Configuring, saving, and comparing strategy parameters within your account Accessing educational content, documentation, and support resources made available through the Platform Communicating with our support team for assistance with your account or subscription All permitted use is subject to compliance with this AUP, the Terms of Service, all other incorporated policies, and all applicable laws and regulations.
3. PROHIBITED CONDUCT — SYSTEM INTEGRITY
3.1 Unauthorised Access. You must not attempt to gain unauthorised access to any part of the Platform, including its backend infrastructure, databases, APIs, administration interfaces, or third-party data feeds. This includes attempting to bypass authentication controls, exploit session vulnerabilities, or access accounts or data belonging to other users. 3.2 Security Testing. You must not probe, scan, test, or assess the security or vulnerability of the Platform, its servers, or any network connected to it, without our prior written consent. Authorised security researchers who discover a vulnerability are encouraged to contact us at through responsible disclosure before any public disclosure. 3.3 Harmful Code. You must not upload, transmit, introduce, or execute any malware, viruses, worms, trojans, ransomware, spyware, adware, or any other code, file, or programme that is designed or likely to: (a) damage or corrupt data or systems; (b) intercept or capture communications or credentials without authorisation; (c) create or exploit backdoors in the Platform or any connected system; or (d) interfere with the normal functioning of any user's computer or device. 3.4 Denial of Service. You must not take any action that imposes an unreasonable or disproportionate load on the Platform's infrastructure, including: launching distributed denial-of-service (DDoS) attacks; flooding the Platform with excessive requests; stress-testing or load-testing the Platform without prior written approval; or otherwise disrupting the availability or performance of the Platform for other users. 3.5 Infrastructure Interference. You must not interfere with, disrupt, or compromise the integrity of the Platform's servers, networks, or data pipelines, including those of Third-Party Data Providers. You must not violate the regulations, policies, or technical access controls of any network connected to the Platform.
4. PROHIBITED CONDUCT — AUTOMATED ACCESS AND SCRAPING
4.1 General Prohibition. You agree not to interfere with, disrupt, or create an undue burden on servers or networks connected to the Platform, or attempt to gain unauthorized access to the Platform or to other computer systems or networks connected to or used together with the Platform. Automated access beyond normal human usage patterns falls within this prohibition. 4.2 Bots and Scrapers. You must not use any bot, spider, crawler, scraper, script, browser plug-in, or other automated tool or process to: (a) access the Platform, its user interface, or any of its APIs at a rate or frequency that exceeds normal human usage; (b) extract, harvest, copy, or download historical price data, Simulation outputs, indicator results, or any other content from the Platform in bulk; (c) monitor or replicate any portion of the Platform's features or data for use outside the Platform; or (d) create or populate multiple accounts automatically. 4.3 API Misuse. Where the Company provides an API, you must use it solely within the rate limits and technical parameters communicated by the Company. You must not exceed designated rate limits, share API credentials with third parties, use the API to build a competing service, or attempt to reverse-engineer the API's behaviour beyond what is documented. 4.4 Data Extraction. You shall not use the Platform to harvest, collect, gather or assemble information or data regarding other users, including email addresses, without their consent. You must not systematically extract Third-Party Data Provider data accessed through the Platform for use outside of TrendArcher. Such data is made available solely for the purpose of powering your Simulations within the Platform.
5. PROHIBITED CONDUCT — ACCOUNT MISUSE
5.1 Credential Sharing. Each Account is for the sole use of the individual or entity that registered it. You must not share your login credentials (username, password, or any authentication token) with any other person or entity, whether for free or for payment. Account sharing is grounds for immediate account suspension. 5.2 Multiple Accounts. You must not create multiple Accounts for any of the following purposes: circumventing subscription plan limits or feature restrictions; exploiting free trial offers more than once; circumventing a suspension or ban imposed by the Company; or gaining access to functionality reserved for a higher subscription tier. 5.3 Impersonation. You must not impersonate any person or entity, including any employee, representative, or officer of the Company, or misrepresent your identity or your affiliation with any person or entity, in any communication with the Company or in any use of the Platform. 5.4 False Registration Information. You must not provide false, misleading, or fraudulent information when registering for an Account or at any other time when the Company requests information about you or your business. The Company reserves the right to verify account information and to terminate accounts found to be registered fraudulently. 5.5 Account Transfer. You must not sell, transfer, sublicense, or otherwise assign your Account or any rights under it to any third party without the Company's prior written consent.
6. PROHIBITED CONDUCT — COMMERCIAL EXPLOITATION
6.1 Resale of Access. You must not resell, sublicense, or otherwise provide access to the Platform — in whole or in part — to any third party. This includes selling login credentials to third parties; operating a shared or pooled account service; or offering Platform access as a component of another commercial product or service. 6.2 Resale of Simulation Results. You may use your own Simulation results for personal or internal business research. You must not resell, redistribute, or commercially exploit Simulation results in any of the following ways: (a) offering Simulation results as a subscription data feed or signal service to paying customers; (b) incorporating Simulation results into a competing analytical product without our prior written consent; (c) representing Simulation results as independently generated financial research or analysis produced by your own systems. 6.3 Competitive Intelligence. You must not use the Platform to gather information for the purpose of developing, improving, or benchmarking a competing product or service. This prohibition includes a prohibition against soliciting or recruiting users of the Platform to become members of competitive sites and services. 6.4 Reverse Engineering. You must not decompile, disassemble, reverse engineer, or otherwise attempt to derive: the source code of the Platform; the algorithms used in the backtesting engine or indicator computation modules; the schema of the Platform's databases; or any other proprietary component of the Platform's technical architecture. This prohibition applies whether the purpose is competitive analysis, academic research, or any other reason. 6.5 Benchmarking. You must not use the Platform or its outputs to conduct benchmarking studies, performance comparisons, or competitive analyses for the purpose of publicly marketing a competing product, without the Company's prior written consent.
7. PROHIBITED CONDUCT — MISREPRESENTATION AND FINANCIAL HARM
7.1 Misrepresentation of Outputs. You must not represent Simulation outputs to any third party in a way that overstates their reliability, predictive power, or financial significance. In particular, you must not: Present Simulation results as a guarantee or near-guarantee of future trading profits Represent backtested returns as actual historical trading performance Market Simulation outputs to retail investors as personalised investment advice Use Simulation results in promotional materials for investment products, funds, or managed accounts without making clear that the results are hypothetical backtests subject to the limitations described in our Terms of Service 7.2 Misleading Claims. You must not use the Platform's name, branding, or outputs to make false or misleading claims about your own products or services, including falsely implying that TrendArcher endorses, validates, or certifies your trading strategies or analytical methods. 7.3 Market Abuse. You must not use the Platform or any output derived from it in connection with any activity that constitutes market abuse, market manipulation, insider trading, front-running, wash trading, spoofing, layering, or any other form of financial misconduct prohibited under applicable law, including but not limited to the EU Market Abuse Regulation (MAR), the US Commodity Exchange Act, and equivalent legislation in other jurisdictions. 7.4 Fraud. You must not use the Platform in connection with any fraudulent scheme, including using Simulation results to deceive investors, mislead counterparties, or facilitate financial fraud of any kind.
8. PROHIBITED CONDUCT — LEGAL COMPLIANCE
8.1 Applicable Law. You must use the Platform only in a manner that complies with all applicable laws and regulations in your jurisdiction and in any jurisdiction in which your use of the Platform has effect. This includes, without limitation, laws relating to financial services and securities regulation; cryptocurrency and digital asset regulation; data protection and privacy; intellectual property; export controls and trade sanctions; anti-money laundering and counter-terrorism financing. 8.2 Sanctioned Jurisdictions. You must not use the Platform if you are located in, ordinarily resident in, or acting on behalf of a person or entity in a country or territory subject to comprehensive trade sanctions administered by the United Nations, the European Union, the United Kingdom, or the United States (including the OFAC Specially Designated Nationals list). Providing false information to conceal your location in a sanctioned jurisdiction is a serious violation of this AUP. 8.3 Export Controls. You acknowledge that the Platform may be subject to export control and economic sanctions requirements. You represent and warrant that your use of the Platform is consistent with those requirements. You must not export or re-export the Platform or any output derived from it to any jurisdiction where such export would violate applicable export control laws. 8.4 Intellectual Property. You must not use the Platform to infringe the intellectual property rights of any third party, including uploading, transmitting, or reproducing any content protected by copyright, trademark, patent, or other intellectual property rights without authorisation. You must not use the Platform to circumvent any digital rights management (DRM) or access control measures protecting third-party content. 8.5 Data Protection. You must comply with all applicable data protection and privacy laws when using the Platform, including GDPR, UK GDPR, and other applicable privacy legislation. You must not use the Platform to process the personal data of third parties in a manner that violates applicable data protection law.
9. PROHIBITED CONDUCT — PLATFORM MISUSE
9.1 Circumventing Controls. You must not attempt to circumvent, disable, or interfere with any security feature, access control, subscription limit, or technical safeguard implemented by the Company, including but not limited to: rate limiting mechanisms; plan-based feature gating; account verification processes; and payment processing controls. 9.2 Exploitation of Errors. If you discover a bug, error, or unintended functionality in the Platform that provides access to features, data, or functionality beyond what your subscription entitles you to, you must not exploit that error. You must report it to us promptly at . Deliberate exploitation of system errors is a serious violation of this AUP. 9.3 Interference with Other Users. You must not take any action that interferes with another user's ability to use and enjoy the Platform, including actions that degrade Platform performance for other users or that manipulate Platform features in a way that harms other users' experience.
10. MONITORING AND ENFORCEMENT
10.1 Right to Monitor. The Company reserves the right to monitor usage of the Platform for compliance with this AUP, including monitoring access patterns, Simulation volumes, API call rates, and account activity. Monitoring may be conducted on an automated basis and/or by human review. 10.2 Investigation. The Company reserves the right to investigate and take appropriate action against you in its sole discretion if you violate any provision of this AUP. We may investigate suspected violations with or without advance notice to you. Cooperation with investigations is expected and required. 10.3 Enforcement Actions. Upon finding a violation of this AUP, the Company may, at its sole discretion and without prejudice to other remedies, take any or all of the following actions: Issue a written warning and require you to remedy the violation within a specified period Temporarily suspend access to the Platform pending investigation or remedy Permanently terminate your Account, with or without notice depending on the severity of the violation Remove, restrict, or quarantine any data or outputs associated with the violation Recover any costs, damages, or losses incurred by the Company as a result of the violation Report the violation to relevant law enforcement authorities, financial regulators, or data protection supervisory authorities Initiate legal proceedings, seek injunctive relief, or claim damages 10.4 No Refund on Termination for Cause. Account termination for violation of this AUP does not entitle you to any refund of prepaid subscription fees, whether for the current or any prior billing period. 10.5 Immediate Termination Triggers. The following violations will result in immediate account termination without warning, without notice, and without any right of appeal or refund: Using the Platform to facilitate fraud, market manipulation, or other financial crime Deliberate deployment of malware or attacks against the Platform's infrastructure Creating multiple accounts to exploit free trial features more than once Sharing account credentials commercially (account reselling) Attempting to reverse engineer the backtesting or indicator computation engine Repeated or egregious violations of any provision of this AUP after prior warning 10.6 Cooperation with Authorities. The Company will cooperate fully with law enforcement agencies, financial regulators, and supervisory authorities investigating violations of law that relate to use of the Platform. We may disclose account information, usage logs, and Simulation data to such authorities without notice to you where required or permitted by law.
11. REPORTING VIOLATIONS
If you become aware of any use of the Platform that you believe violates this AUP — including by another user — please report it to us at: Email: Subject line: "AUP Violation Report" Please include as much detail as possible, including the nature of the suspected violation, any relevant account identifiers or URLs, and the date(s) on which you observed the behaviour. We treat all reports confidentially. We do not guarantee a response to every report but will investigate all credible reports.
12. RELATIONSHIP WITH TERMS OF SERVICE AND OTHER POLICIES
This AUP is incorporated into and forms part of the TrendArcher Terms of Service. In the event of any conflict between this AUP and the Terms of Service, the Terms of Service shall prevail. This AUP should be read together with our Privacy Policy, Refund and Cancellation Policy, and Cookie Policy, all of which are available at trendarcher.com.
